Privacy statement for Movingdots GmbH applicants

We are delighted that you would like to apply to join us. In the following, we explain how we process the personal data that you provide us with as part of the application process.

1. Definitions:

Personal data is any information relating to an identified or identifiable natural person ("data subject"). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. Processing is any operation or set of operations which is performed on personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction. The controller is the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. The data subject is the employee.

2. What data do we process?

As part of the application process, we collect and process personal data that you have provided to us, namely contact and address details, your application photo and information on your career history, school education and professional training.

3. The purpose of processing is to carry out the application process and select the applicant.

4. On what legal basis do we process your data?
The legal basis is Article 6 (1)(b) GDPR, namely the performance of pre-contractual measures.
We receive the data from you. If we do not collect personal data directly from you, we will also inform you of the source of the personal data and, if necessary, whether this is obtained from publicly accessible sources.

5. Will your data be transmitted to third parties?

The data transmitted in the course of your application will be transferred via TLS encryption and stored in a database. This database is operated by Personio GmbH, Rundfunkplatz 4, 80335 Munich, Germany, which provides personnel and applicant management software (https://www.personio.com/legal-notice/). In this context, Personio is our processor in accordance with Article 28 GDPR. The basis for processing is a data processing agreement between us as the controller and Personio.

As part of the application process, data may also be transmitted to other service providers, Group companies and affiliated companies. Data is only passed on to third parties to the extent permitted by law and to the extent necessary for completion of the application process. Data is transferred to third countries outside the European Union. This is carried out on the basis of contractual regulations provided for by law, which are intended to ensure adequate protection of your data and which you can consult on request.

6. Storage duration:

We only store your personal data for as long as it is required to achieve the processing purpose or if storage is subject to a legal retention period. If we are unable to offer you a job following the application process, we will delete the data collected in our systems six months following completion of the application process, unless you give us your consent for longer-term storage.

7. Your rights:

You have the right to a) request information about the processing of your data, b) receive a copy of your personal data, c) rectify your data. If your personal data is incomplete, you have the right, in due consideration of the purposes of processing, to complete the data, to have your data deleted or blocked, to have data processing restricted, to object to the processing of your data, to withdraw your consent to the processing of your data in future and to complain to the competent supervisory authority about unauthorised data processing. Unless explicitly stated when data is collected, the provision of data is not required or mandatory. Such an obligation may arise from statutory or contractual regulations.
